The purpose of a Section 5 of the Planning and Development Act 2000, as amended, is to establish if a particular development is or is not an exempted development within the meaning of the Act.
If you are not sure if your development is exempt of not. You can apply for a document called a declaration of exemption which will confirm whether or not you require planning permission.
In accordance with the Planning and Development Act 2000, as amended any person may request a declaration from the Planning Authority as to whether a development is exempted from requirement for planning permission or not.
To request a declaration for a Section 5 exemption, submit the following:
Application form
Location Map (scale 1:1000 in urban area), with the site clearly outlined in red.
Full details and description of the proposed development.
Scale drawings and elevations.
