Taking in Charge of Estates Request

Developers or the majority of home owners can request the local authority to take charge of the roads and services within a housing estate.

Taking in Charge Policy and Form

A private housing estate can be defined as one comprising two or more houses which are served by access road(s), open spaces, car-parks, sewers, watermains and drains.

The taking in charge by a Local Authority of a Private Housing Estate shall be carried out in accordance with Section 180 of the Planning and Development Act, 2000 and Section 11 of the Roads Act, 1993.

A developer wishing to have a residential estate taken in charge shall complete and submit the Taking in Charge of Residential Estates Application Form. The form may be submitted by post to:

Approval of projects (residential estates) under the Developer Provided Water Services Infrastructure under the Multi-annual Developer Provided Water Services Infrastructure Resolution Programme 2019-2021

Circular L1(DPI)01-2019 (24 July 2019) sought bids from local authorities for funding under the Developer Provided Water Services Infrastructure Resolution Programme 2019- 2021. A total number of 19 local authorities with Developer Provided Water Services Infrastructure in residential estates in their areas made applications for funding.

Roads & Services Letters

If you need a letter stating that roads and services are in the charge of Tipperary County Council you should write to the Council’s Roads Department, Civic Offices, Limerick Road, Nenagh, Co Tipperary and attach:

(a) €90 fee made payable to Tipperary County Council

(b) A legible Ordnance Survey or Land Registry Map with the site/ property outlined on the map in colour and the road abutting the property highlighted or marked ‘X’ to ‘Y’.
